The following general terms and conditions apply to the travel contract between the customer and the tour operator. teamtravel GmbH - hereinafter referred to as "the Organiser" - if this has been validly agreed.
The brands mannschaftsausfahrt.de, eurotournaments.com & trainingslager.com belong to teamtravel GmbH.
The general terms and conditions supplement the statutory provisions in §§ 651a to m BGB and the information regulations for tour operators in §§ 4-11 BGB-InfoV.
The general terms and conditions do not apply if the organiser only acts as an agent for individual travel services and separately informs the customer of this fact.
1. conclusion of contract
- The organiser offers group tours via its homepage or other advertising media. With your registration, you offer the organiser the binding conclusion of a contract for participation in the desired trip. The contract is concluded when we confirm the booking of the trip to you in writing. Confirmation by email is sufficient. Agreements made by telephone or verbally only become binding when they are confirmed by us in writing.
- The registration is made by the applicant also for all participants listed in the registration/lists, for whose contractual obligation the applicant is liable as for his own obligations.
If the booking cannot be realised according to the registration, the client will receive an adjusted offer. The organiser is bound to this offer for ten days.
2. performance
- The service obligation of the Tour Operator results without exception from the booking confirmation, the offer as well as the current travel information on the internet, taking into account all information, explanations and notes contained therein.
- The organiser is not liable for information provided by the third party providers involved, such as hotels or airlines.
- The organiser is only entitled to make changes or deviations to certain travel services if these do not influence or affect the entire booked itinerary. In any case, the organiser is obliged to inform the client in writing of any subsequent changes and to give reasons for them.
- In the event of serious changes to the booked services, the customer has the right to withdraw from the travel contract or to demand the booking of an identical or higher-quality trip. Verbal demands are not valid in this case.
- Details of the luggage allowed (this includes both hand luggage and checked luggage) will be given in writing in the quotation and will vary depending on the carrier.
If the use of sports facilities is included in the tour price, the following shall be deemed agreed: The determination of the unplayability of the sports facility is the responsibility of the respective operator of the sports facility(ies). If it is not possible to use the booked sports facilities, this constitutes a travel defect for which the customer is entitled to a reduction of the travel price in accordance with §651m BGB (German Civil Code) in the amount of the expenses actually saved. Any further compensation according to §651n BGB is excluded.
3. payment
- Upon receipt of the booking confirmation, a deposit equal to the team registration fee and 20% of the remaining total amount is due.
- The customer will receive the travel documents up to 10 days before the start of the tournament.
- The balance, unless otherwise stated in the booking confirmation, is due no later than four weeks before the start of the tournament.
- The organiser may also refer to an earlier payment of the balance in the booking confirmation.
- In the case of bookings at short notice, payment of the total tour price must be made immediately after conclusion of the contract and sending of the security certificate.
4. price change
- The organiser reserves the right to change the tour price prior to conclusion of the contract due to an increase in transport costs, charges for certain services, such as port or airport fees, aviation security costs or entry fees, tax increases on booked services or a change in the exchange rates applicable to the relevant end trip after publication of the brochure or the advertisement. This increase may not exceed 5% of the total tour price. Should the price increase be higher than 5%, the customer may withdraw from the trip.
- The price increase may only take place up to 21 days before the start of the journey and must be communicated to the customer immediately after notification.
- The customer must assert his/her rights without delay, at most 10 days after notification of the change.
5 Cancellation, rebooking or withdrawal by the customer
- The customer can withdraw from the tour at any time before the start of the tour. The withdrawal must be declared in writing to the organiser at the business address of teamtravel GmbH, a withdrawal by email is not sufficient. The customer should give reasons for the withdrawal in writing.
- If the customer does not take the trip or withdraws before the start of the trip, the organiser loses the claim to the price of the trip. Insofar as the withdrawal is not due to the fault of the organiser or is a case of force majeure, the organiser can demand reasonable compensation for the travel arrangements made up to the point of withdrawal and his expenses in relation to the respective travel price. When calculating the compensation, usually saved expenses and usually possible alternative use of the event services are to be taken into account. You are at liberty to prove that no costs or significantly lower costs were incurred in connection with the cancellation or non-commencement of the trip than the costs shown by us in the flat rate (see 5.3).
- The following costs are to be paid in addition to the handling fee of 25,- Euro per booking transaction in case of withdrawal (also of single persons) from the trip as a rule:
- up to 60 days before the start of the event: 30% of the participant price plus 100% of the flight price (if booked)
- from the 59th to the 31st day before the start of the event: 50% of the participant price (per person) plus 100% of the airfare (if booked)
- from the 30th to the 16th day before the start of the event: 70% of the participant price (per person) plus 100% of the airfare (if booked)
- from the 15th day before the start of the event: 90% of the participant price (per person) plus 100% of the flight price (if booked)
- in case of no-show at the beginning of the event: 100% of the participant price (per person)
plus 100% of the airfare (if booked)
- Special offers/packages, individual travel modules and individually designed trips may be subject to more specific cancellation conditions. This will be pointed out separately in the respective offer.
- Should the actual compensation be higher than the above flat rate, the organiser reserves the right to claim this. The organiser must justify and prove this.
- The customer can request a change in the number of participants at any time. If teamtravel can fulfil the request, the booking confirmation will be changed. For this process an additional processing fee of 15,- Euro per booking process will be charged.
6. services not used
If the traveller does not make use of the travel services for reasons for which he/she is responsible, he/she is not entitled to a proportional refund of the travel price. However, the organiser undertakes to make every effort to obtain reimbursement of the expenses saved from the service providers.
7. changes or withdrawal by the organiser/Cancellation of the event/trip due to force majeure / Covid-19
The organiser assumes that all tours will take place as usual. In the event that this is not possible, the organiser will cancel individual trips.
A cancellation occurs exactly when the responsible authorities prohibit the hosting, a travel ban or an official travel warning for the affected region is given.
In this particular case, the organiser shall immediately refund the entire participant price paid without any deductions.
The organiser can terminate the contract without notice if the participant persistently disrupts the implementation of the trip despite a warning by the organiser or if he/she behaves contrary to the contract to such an extent that the immediate cancellation of the contract is justified. If the organiser cancels the contract, the organiser retains the claim to the participation fee minus the value of the saved expenses as well as the saved advantages resulting from an alternative use of the services not used.
The hotelier/owner/operator of the booked accommodation/sports facility may ban the customer from the premises at any time for good cause. The customer is obliged to inform the organiser immediately by e-mail of a house ban.
8. obligations of the client(s)
- If the customer has not received the required travel documents (e.g. e-ticket vouchers, hotel vouchers) by seven days before the start of the trip despite having paid the travel price on time, he/she must inform the organiser immediately. This applies with the exception of short-term bookings.
- The traveller is obliged to notify the organiser immediately of any defects and to demand a remedy. This is the duty of the customer. If the traveller culpably fails to report the defect, he/she has no right to a reduction of the tour price. The tour operator must provide a remedy if this is possible and the circumstances allow it.
- Luggage delays and damage are to be clarified directly on site with the associated airline. The organiser can only intervene in a supportive capacity.
9 Liability, Exclusion of Claims and Limitation of Actions
- The contractual liability for damages that are not bodily injuries is limited to three times the participant price (per person), insofar as damage to the participant is neither
was caused intentionally or by gross negligence or we are responsible for a loss incurred by the participant solely due to the fault of a service provider. Legal provisions limiting or excluding liability based on international conventions, which may be invoked by a service provider engaged by us, shall also apply in our favour. For all claims for damages in tort against the organiser that are not based on intent or gross negligence, liability for property damage is limited to the amount of three times the participant price (per person and event).
- The organiser is not liable for service disruptions, personal injury and material damage in connection with external services that are merely arranged and expressly identified as such in the advertisement (e.g. excursions; tours, visits to parks and other leisure facilities).
- The customer has the obligation to handle borrowed equipment of all kinds with care. Should damage occur, the organiser is not liable. In this case, the client must replace the equipment in the same quality or bear the costs for a new purchase himself/herself.
- The organiser is generally not liable in the event of force majeure.
- Participation in sports and other leisure activities is the responsibility of the participants and fellow travellers. You should check sports facilities, equipment and vehicles before using them. The organiser is only liable for accidents that occur during sporting events and other leisure activities if the company is at fault. The organiser recommends that you take out accident insurance.
- Each participant/co-traveller is obliged to cooperate within the framework of the legal provisions to avoid or minimise any damage in the event of disruptions to services. Defects and disruptions are to be reported to the staff immediately, the organiser recommends the written form. If a participant/traveller fails to comply with this obligation through his/her own fault, he/she shall not be entitled to any claims in this respect.
- Staff members on site are not authorised to accept claims of any kind. Claims of any kind are to be submitted to the respective management authorised representative of the organiser on site. The organiser recommends the written form.
- Claims for non-contractual performance of the booked tour must be asserted with the organiser within one month of the contractually agreed end of the tour. We recommend the written form. After expiry of the deadline, you can only assert claims if you were prevented from complying with the deadline through no fault of your own. Your claims arising from this contract are subject to a limitation period of one year, expressly deviating from the statutory regulation. The limitation period begins on the day on which the event should end according to the contract.
10. passport, visa and health requirements
- The Tour Operator shall inform nationals of a state of the European Union in which the tour is offered about the legal situation and provisions of passport, visa and health regulations before conclusion of the contract and about any changes to these before the start of the tour. For nationals of other countries, the relevant consulate will provide information. The organiser does not take into account special circumstances such as dual citizenship, statelessness or others.
- The traveller is responsible for complying with all regulations that are important for the implementation of the trip. All disadvantages resulting from non-compliance with these regulations shall be borne by him/her, except if they are caused by culpably incorrect information provided by the tour operator. If entry regulations of individual countries are not complied with by the traveller, or if a visa is not issued in time by the diplomatic representation through the fault of the traveller, so that the traveller is therefore prevented from taking part in the trip, the tour operator is not liable.
11 Ineffectiveness of individual provisions
The invalidity of individual provisions does not justify the invalidity of the rest of the travel contract.
12. information requirements on the identity of the operating air carrier
- The EU Regulation on the information of air passengers on the identity of the operating air carrier (EU 2111/05) requires the organiser to inform the customer of the identity of the operating air carrier(s) of all air transport services to be provided within the framework of the booked travel at the time of booking. If the operating airline is not yet known at the time of booking, the organiser shall inform the customer of the airline or airlines likely to operate the flight. As soon as the organiser knows which airline will operate the flight, the customer will be informed by the organiser. If the airline named to the customer as operating the flight changes, the organiser shall inform the customer of this change. The organiser shall immediately take all reasonable steps to ensure that the customer is informed of the change as soon as possible.
- The organiser is prohibited from offering the customer flights with airlines that are subject to an EU operating ban. The list of airlines with an EU operating ban ("Black List") is available on the following website: http://ec.europa.eu/transport/modes/air/safety/air- ban/index_en.htm.
13. miscellaneous
- Clients:inside are responsible for providing the necessary information required for the organisation of the trip (e.g. information on allergies, eating habits, disabilities, lists of participants etc.).
- If a visitor's tax is payable on site, this must be paid directly on site unless otherwise agreed in advance.
- With the conclusion of the travel contract, the applicant assigns the image rights to the organiser on behalf of all.
- The customer is prohibited from passing on or distributing copyright-protected products.
14 Applicable law and place of jurisdiction
- German law shall apply exclusively to all actions and negotiations.
- The place of jurisdiction is Hamburg.
15. final provision
The conditions apply to all agreements between the organiser and the client/customer, irrespective of the domiciles of all parties involved and the place where the contract came into being and the place where the service is to be provided.
